I went bankrupt on 10/4/08.I was told by the judge that I wouldnt be asked by the OR for any payments due ,to in his opinion, my lack of excess funds.WELL... by the time the OR had finished with me,a 1 1/2 hr call,they decided i have to pay £70 pm for the next 3 yrs.This is travelling money set aside to visit my children that live with my ex husband 200 miles away.They also reduced my food/household essentials from £195 pm to £170 pm.I have appealed against this decision as they have also not allowed for car maintainance or prescription charges,personal hygiene etc etc.I recieve regular prescriptions for 'womens problems'which as we all know are not cheap.My expences show i have approx £20 pm disposable income and this is NO LIE!!! Do they want me to get into debt again??

I have also just been turned down by the co op after they accepted me on the telephone.I told them from the onset of the application that i was bankrupt!.. I need an account as my employers ONLY pay by BACS.I have tried everywhere and simply do not know what to do.I am now likely to lose my job.I am at my wits end about where to turn ,can anyone advise me?

me and my partner opened a co-op cashminder joint account the morning we declared ourselves bankrupt- are you sure it was a cash minder account that you applied for? The only check that they do is that you are on the electoral roll. We opened it in the branch so we were sure of everything that was being entered.

You get a visa electron card which isn't as good as a debit card but you can use it in most shops on the high street plus internet shopping. You can have direct debits, standing orders and get internet and telephone banking. We have had no trouble with them at all. I got the account number by calling my contact at the branch about 3/4 days after we applied. I would definitely try again if you can make it to a branch. There is also no fee.

Hi Whatever

The Key on an Income Payment Agreement - is that for it to come into effect you have to agree to it - if you do not then the OR will need apply to the Court for an IPO Income Payment Order - the judge will then decide whether the claim is reasonable so provided expenditure can be substantiated and is within usual tolerances then there should not be an issue.

I am on the electoral roll as think banking used this for the telephone id acceptance procedure and it took a matter of minutes.I really have no idea why.I recieved a letter this morning simply stating i was unsucessful with no explanation.I cannot get an answer from them via telephone as apparently they do not divulge such info this way.I thought seeing as i have full time employment it wouldnt have caused a problem but there you go ,you live and learn i guess.

Regarding the Co-op account, are you on the electoral roll at your current address? This is one reason they will turn you down. It might be worth checking with your council as when I moved a couple of years ago I filled out the forms and the council 'never received them'.

I have opened an account with Think Banking over the phone and recieved an account number etc within 15 minutes.

I had already telephoned barclays with no sucess.Also nationwide who were very snooty when i told them i was bankrupt.Ihave already appealed to the OR with several points of expenditure which can be backed up with doctors letters etc so i'm keeping my fingers crossed on that.

I have never had a co-op account.I cannot understand it.I told them when i applied that i had just gone bankrupt and they said fine!.They said over the phone y applicationwas sucessful but thenrecieved paperworksaying 'accepted inprinciple.I just telephoned them this morning to get my account number to give to my employers thats when they told me i was unsucessful.My employers will not pay through a 3rd party either so I'm basically stuck.

re the bank account

barclays do a basic account, think banking offer an account but costs 12 per month OR you could look at a tuxedo card. This is a prepay mastercard but you can be paid by bacs. http://www.tuxedocard.com/

the income payment agreement is not a final decision just their pitch of what they would like you to pay.

household at 195 is too high but can't see any reason why travelling costs to see children in unacceptable as indeed medical expenses are also a critial monthly expense.

try going back calmly and identifying each point and why you believe it is justified.

if it gets to the point of an income payment agreement the judge would need to decide what is reasonable

Hi Whatever,

If you appeal an Income payment Agreement and they refuse to negotiate it will go to court for an Income Payment Order where the court will look at you income and expenditure, From the sounds of it you have not had a pleasant experience with your particular examiner and im afraid this does happen, but if your income is as you say you may find the court more reasonable.

This is the first I have heard of the Co-Op turning people down for an account, did you owe them money when you declared Bankruptcy?

I also work for an agency that pay holiday pay inc.in hourly rate.This mean I have to spread my income over the entire 52 weeks,surely this lessens my excess income also? or are you expected to work 7 days a week 52 weeks a year?. I'm not even asking for money to be put aside for a holiday as such as I can't even remember the last time i had one.All my money is tied up in bills/household expences.I don't earn a fortune,i work as a support worker at secure units and health care pays peanuts but its my job !
