my husband and i are seperating he said i can transfer the house into my name and keep it for the kids sake who are in the catchment area for the school,as long as i give him time to find somewhere else to live before he has to move out,he has 50k of debt and thinks he is going to have to go bankrupt,he is out of work due to a spinal problem and is only recieving incap as income!i would like to know if the house will be safe for me and the kids if the mortgage is transfered to my name or if he does go bankrupt will this cause me a problem?

You would also be very wise to consult a matrimonial lawyer who can advise you of your rights in family law as well as insolvency.

the important thing is that your husband hasn't given away assets that would have been in his estate and be a benefit for his creditors.

I would suggest that you and your husband get professional advice as there are several options other than Br than in certain circumstance may be more appropriate.

I beleive it will cause a problem. The trustee will want to see what equity there is is the property and will probably want you to pay half.

I am not an expert but I am sure one will anwer later.
