Im currently in an IVA and considering bankruptcy.

4 years ago I split from my partner and he bought me out of the house, I received approximately £7,000 (I also paid all his legal costs). The money I received I paid off some debts and Im scared because I can't honestly remember who I paid and how much and whether I spent any of the money on myself or not. It's as if I have blocked out that part of my life. I am now so scared that I am going to get into trouble or be subject to a BRO because of this.

Hi Maizie,

In the case of an IVA that fails, unfortunately BR is usually the only option available. Don't be too concerned, as you've done nothing that tens of thousands of people haven't done before you!

I have contacted my Supervisor, my situation has changed recently, I have gone from paying £371 into my IVA for the past year, I paid £350 rent inclusive of bills to a family member to having to leave the property and move somewhere else... with my boyfriend of 6 months. I am therefore having to pay rent and bills so my disposable income has gone down to less than £200 a month. My Supervisor doesn't think my creditors will agree to this drop so bankruptcy it is. I have no assets.

Hi Maizie,

As Melanie says, your first port of call should be your IP to see if your payments can be adjusted to a more affordable level.

I sincerely doubt that you'd get a BRO as a result of this. As long as you're honest with the OR, I doubt you'd have anything to worry about.

Hi Maizie and welcome to the forum

Sorry to hear that your IVA is failing - is there any particular reason for this? Have you tried to talk or negotiate with your IP at all?

I would not worry about the transcation 4 years ago. The OR is not likely to be too interested in what happened to a relatively small sum of money.
