Posted - 02 July 2008 : 12:58:50 HELLO AGAIN WE LIVE IN A RENTED HOUSE AND HAVE FOR THE PASSED 3 MONTHS WE LEFT OUR HOUSE THAT WE PAY A MORTGAGE ON AS WE HAD A SECURE LOAN ON THE PROPERTY AS WELL SO NO MONEY LEFT IN THE PROPERTY. THE MORTAGE IS £178000 AND SECURE LOAN IS £57000 SO I HAVE MISSED THE PAYMENT ON THE MORTAGE I HAVE INFORMED N/ROCK THAT WE ARE GOING BANKRUPT AND THEY HAVE SENT OUT FORMS FOR US TO SURRENDER THE HOUSE BUT IM UNSURE ABIUT THEM AS IT SAY THEY WILL SALE THE HOUSE BUT ANY SHORTFUL THEY WILL COME TO US FOR THE MONEY SO NOT SURE WHAT TO DO ABOUT THAT. ALSO WE HAVE A PROPERTY DOWN SOUTH AND MY HUSBAND WORK HAVE A LEGAL CHARE ON THE PROPERTY FOR £218000 AND THE HOUSE HAS BEEN ON THE MARKET FOR OVER A YEAR AND HAS NOT SOLD AT £218000 SO MY HUSBAND INFORMED HIS EMPLOYER THAT WE WERE GOING BANKRUPT AND THEY SAID THEY WOULD TAKE OVER PROPERTY TO GET MONEY BACK SO WE HAVE SIGNED POWER OF SELL OVER TO THEM. SO NOT SURE HOW OR WILL DEAL WITH THIS. AND DOES THIS MEAN THAT WE STILL HAVE THE HOUSE SO SAY I DOESN'T SALE WILL IT COME BACK TO US TO GIVE THE MONEY BACK. AS WE ARE GOING BANKRUPT ON FRIDAY SHOULD WE BE TAKING THIS HOUSE THROUGH EVEN IF IT DOES ROCK THE BOAT WITH MY HUSBANDS WORK. HEL PLEASE , THANK YOU |

Posted - 02 July 2008 : 13:01:33 Ensure you list all mortgages/secured loans/charges on the unsecured section of your SOA as well as secured. This way, any shortfall will become a new unsecured debt and written off in your BR.
