Just a new one to my quesitons i have recently been billed for overpayment of WFTC by the inland Rev and also had a bill from CSA for my husbands old child support.
My question is we have agreed a payment in principle with these but do they get included in the BK and go with the other debts or will they stay as they are. Will they get hopefully written of, I have written these on the SOA so just wondering will we be stuck with these too as combined they are over £6000 in total.

I always advise that if in doubt, full disclosure and total honesty with the OR is the way to go.

Hi although it wont be included i have written it in my list of creditors on my SOA is that right. As both the debts thats the Inland Revenue and CSA have as far as i am aware creditors, they are debts that I am supposed to pay so i wrote them in the creditors part so that they cana be included and shown as additional debts that we owe.
The overpayment part was because we were claiming as a couple and having the overpayment taken weekly from the current amount, then hubby left me only for a week or so due to the pressure the debts had caused, so i then called them and changed the claim, only then to have to call them again and confirm hubby was back. Then i had to reapply and start again so the debt then becomes payable and thats why we ended up with the bill now.
Have i done the right thing by adding them both into unsecured creditors so the OR can see these debts and they dont get left out.

They cannot deduct overpayments of tax credits from future benefits. HMRC will claim as an unsecured creditor in a bankruptcy or IVA.

My understanding that as with benefits, they can deduct overpayments from future amounts due, despite bankruptcy.

My overpayment of WFTC has been included in my BR but as far as I am aware CSA debts can not be included.
