Posted - 17 July 2008 : 09:52:13 Hi, i have been told that my wife can claim half the property even though the mortgage is in my name only. We have lived in the house for nearly 8 years and will the bank with a secured loan push for me to sell even though they would have to pay off the first chargeholder, i am not in arrears with the mortgage and i shall beable to keep paying the bankloan via my wife after going bankrupt

Your wife can claim an interest in the property, but I would suggest you get some specialist legal advice.
The secured loan holder could repossess if they wish, but are unlikely to do so as long as you maintain payments.
