Hi,

I wnet BR in May owing 55k. I transferred house to wife in March when we remortgaged (came off fixed interest deal) as I had drawn out 65K 2 years ago to pay off my debts. We had a declaration of trust drawn up.

I got into the mess by spreadbetting and have been completely honest with them, even sending them my betting statements in Excel format.

It looks like my assets are going to be managed by the RTLU, and they are entering the BRO process for me as they have asked me to come in at some point to put my side of the story across (2 face to face interviews then!).

Obvioulsy things are going to start moving now and I was wondering if it is worth employing an external agency now to put me in the best light, and to help defend any decisions to overturn the house transfer to my wife (equity of exoneration and all that).

My question is - is this advisable, and how expensive are these options...has anyone else employed this tactic and has it worked. Obviously, us bankrupts dont have a great deal of spare cash to waste and I doubt such experts come cheaply. Can such people attend interviews with you or help you prepare your responses in advance...can they defend any decisions to overturn property transfers? Can they negotiate on your behalf with the RTLU to negotiate a purchase of any beneficial interest deemed to be in the property!?

Lots of questions, but I am now thinking the honeymoon period is over and once this goes to the RTLU and the letter of application for a BRO goes to the Secretary of State, I am going to be entering rough waters and may need a steady hand on the rudder!

This is a question that I cant answer im affraid. I think a lot of other people have done this themselves, but again it is really a matter of personal choice.
You could giving John a call later and speak to him about this he may be able to offer better advice over the phone.
As for the RTLU from what I am starting to understand many cases go over to them now but for most that does not mean automatic BRU/BRO's but a higher level in the BR process that enables the creditors to gain something back from selling for example your home as this is an asset. Again im still learning and although im picking up on stuff John would be the better one to actually ask about taking someone to represent you.
I dont know if any advice here is of help,i hope it eases a bit of the stress and i do hope that you get this sorted out sooner rather than later.
