Posted - 05 March 2010 : 18:15:07 can anyone clarify for me whether or not the OR should take into consideration Child benefit when looking at your incomings? We were told prior to bankruptcy that this was untouched income. Also, we have approximately £165 per month disposable income, what should an IPA be on this, is it a percentage of anything over £99 or is it a percentage of the entire amount?

Posted - 05 March 2010 : 22:55:31 When did you get the original advice, The IS changed their position in june last year after receiving further legal advice, Bankruptcy rules can be very fluid and small changes are made every year. Of course you need to very sure that you include all appropriate expenses as well as all apropriate incomes (think what child benefit pays for)
You dnt really have a choice not to return the forms, remember you have an obligation to co-operate with the IS and they can re-check your i/e at any time

Posted - 05 March 2010 : 22:24:01 Ok thanks. As useful as I've found this website I have found we've received very conflicting advice. As stated previously, we were advised on several occassions that whilst tax credits were considered, child benefit wasn't!
My case has been passed to RTLU for early discharge and when I filled out my expense form again for review they've now decided I should be paying an ipa whereas the OR in Leeds had previously said I didn't qualify for one! It's very frustrating and had I known they were going to do this I wouldn't have returned the form and would have waited to be discharged automatically!!!
I return to work from maternity leave in July though and we'll have an extra £300 per month to find in childcare so can't see ipa lasting long!
