Posted - 09 July 2010 : 14:45:55 i have just been filed with a bankruptcy petition for failiure to comply to a statutory demand from a company that i have never heard of i am thinking that this maybe in respect of a credit card bill that i accrued about 10 years ago, how do i get information about this and can i object to the petition under the grounds that i do not agree to the amount (i was in the process of passing the original details of the amount outstanding to an unfair credit card charges company)or do i just pay it and take the hit?

As has been said, time is now of the essence.
You need to seek an application to set aside the application for a Statutory Demand. It can be done, I successfully achieved just that for one of our daughters early this year.
The DJ awarded my daughter costs too and he (the creditor) had to pay!!

time is against you on this one
email or call one of the experts listed to the left, it will take alot of leg work to find a solicitor with the specific experience you require.
if you email a couple of experts over the weekend they should get back to you early next week, you may be suprised that one may be working at the weekend

The process is that, if a creditor issues a statutory demand, and you do not respond within the allotted period, it is entitled to issue a bankruptcy petition on the ground that you have had time to respond and dispute the debt.
You may have grounds to set aside the petition if you did not receive the stat demand, and you may have grounds to dispute the petition if you are in genuine dispute over the amount, but you will need to act quickly, and I would suggest speaking to a solicitor experienced in bankruptcy matters, or to one of the experts whose details you can find on the left of this page.
