Hi All i am in court tommorrow at 10am but i have a million and one questions.

1st: I told my iva company over a months ago that i was no longer able to pay my monthly contributions as I have lost my job and I that I was going to declare myself bankrupt. They said they would send out a certificate stating that I had failed my IVA. I still have not recieved the certficate so i phoned them today to ask where it was and they said they had not even sent it. I told them I neded one urgently as I am due at court tomorrow and have already canclled my appointment twice due to not having received the certficate. They finally e-mail a copy of the letter to me at 4pm today and said they have put the original in the post but I wont get this until Friday. Will the court accept the emailed copy of the certficate? Also the letter states that I asked for the IVA to be terminated, which I did but this was only due to the fact that they had already told me that if I did not make a payment they would fail the IVA. Will this look bad on me? I dont want to go tomorrow for them to say sorry we are not able to declare you bankrupt and I lose the 600fee. My luck they probably will.

2nd: How do i know if i have filled the forms out correct. My Fiancee has helped me but having spoken to people on here they have said that they have paid a company, who have filled all their paperwork out for them, but this wasn't an option for me as I dont have that sort of money. I have submitted the forms now and printed them off but what if I have missed out some vital info!

3rd: Where on the forms do I have to sign as there just seems to be boxes everywhere? Im dyslexic and have really struggled with this whole bankruptcy thing.

Please someone help!

The ofiicial receiver will go through your statement of affairs with you from start to finish and ask you some questions. Normally the call will last anywhere between 30 mins and 1 hour but as long as you give them the same info that is in the satement of affairs then you will be fine. I would advise that you read through your copy of the statement so you are familiar with it and the information you submitted.

Hi all i am now bankrupt as of 11am this morning. Just wondering what happens fron now. the lady at court told me that the OR will contact me within 24hrs what does she/he want from me. are they on my side. Any info would be much appreciated. one more question i got declared bankrupt as of today can i open a bank account or do i have to wait.

The court will except a the emailed termination certificate or letter as long as it is signed. District Judges have recently been updated on insolvency proceedures and are now fully aware of all rules and regs.

If you had submitted your statement of affairs and there is information missing or you are worried about things you have left out, then when you have your telephone interview with the official receiver you will be able to go through the form with them. They do this anyway and will ask you questions on the information you gave so then if anything is missing you can tell them then.

The court clerks will show you where to sign, its a shame you could not of got help with the forms.

Everytime we go to court we see people who have missed big chunks of information out and the court will not make them bankrupt.

The main thing for yourself is to be honest with the official receiver and if they ask for any copies of bills etc send them in.

I filled out my own forms after talking with an expert. U will be fine. As already said the clerk will check your forms and make sure they are signed where they should be.
You will have a weight offyour shoulders wen it's done.

Good luck for tomorrow. I am doing it too tomorrow at 10.30 and am worried to death but hey ho, lots of people have done it and survived so I'm sure we will too.

1. I think that will suffice, If the judge asks, just tell the truth, you asked to fail the IVA because you knew you could not afford the next payment and there was no point dragging it out longer for creditors.

2. This is why you have an interview, i have not seen many that are 100% correct and that includes many that have been filled out by a company. All the judge is lloking for is that you cannoy pay your debts as they fall due. Everything else is just information for the OR and if you have missed something it is just a case of discussing it with the OR when you have your interview.

3. Dont worry, when you see the clerk at the court, they will check that all the important bits are filled in and show you where to sign
