Why does it cost money to declare yourself bankrupt? THAT'S IDIOTIC. If I had £600 I surely wouldn't be bankrupt!! THAT'S A JOKE!!!!

Ive always thought that one solution would be interim orders, a bit like in an IVA.

Something like you file your papers and automatically get 3 months protection from your creditors, to give you time to save up the fees, If you dont return and pay within the 3 months then the creditors are free to take action. If you do they then grant the bankruptcy.

Just an idea but as i dont make the law i dont think it will be happening

The problem with paying in instalments is that a lot of people wouldn't bother. I used to work in the court service, and people would be fined, given time to pay, and then be back on a warrant as they hadn't paid.

The only way that could work would be if it was an attachment of earnings, which would probably cost too much to administer.

I agree that we should have to contribute towards the cost, obviously the Courts time etc and the OR and staff doing a considerable amount of work, however I do think they should allow some sort of payment scheme for people and treat it like a fine so that people could initially pay a small amount and the rest in instalments. This would make it a lot easier for people and they would still get the money.


Went Br 20th July 2010...Just the OR to face now then countdown for 1 year...Or interview 30th July.

Hi Matt,

As debtinfo has said, the Government has deemed that the debtor must make a contribution towards the cost of petitioning for BR.

The £450, plus £150.00 court costs do not cover the cost as, again, has been explained.

I suggest that you seek some advice from the experts here (on the left hand side) to see what can be done for you - you cannot go forward until you have some assessment of your position.

It costs on average £1715 to administer the bankruptcy. This van only be paid for in 1 of 3 ways. That is the debtor, the creditor or the Taxpayer.

It was decided that the Tax payer should not be paying to help people who cannot afford their debt.

That leaves the debtor and the creditor
You pay the first £450 (Plus £150 is for the court process) and the rest is paid from money that would have gone back to the creditor
