Do you know or have you heard of anyone who has successfully declined a BRU and gone to court and had the term of the BRU/BRO reduced? |

Afternoon Skitty,
I wondered worry too much about it to be honest. When I had the chat with my OR, she mentioned that I could possibly receive a BRU as some of my debts were gambling related. However I never heard anything more after that and I was discharged in March this year without a BRU.

Might be as well to accept it & get on with your life as you say. If you do go to court you have all the stress related to that & worrying will they/won't they reduce it. Did the IP think it worth taking ti court? |

The OR's generally are confident when they go to court, they all go to a central body so that they maintain consistancy. However at the end of the day if it goes to court it is at the discretion of the judge. I have seen some reduced and a few increased (probably more reduced than increased) by far the most common outcome is what the OR applied for.

During the interview the OR said I had made a minor "misconduct" and that I would probally have a BRU/BRO. Her words was as far as term was "max 15yrs would be for financial murder, but as mine was on a much lower level probaly 3yrs on a BRU"
I received a letter from OR with a BRO of 6yrs (or BRU of 5yrs) if I accept by Aug 3rd. I have spoken to an IP (who has seen all OR reports and interview notes) who says that it is on the high side.
Last year with the collapse of my businesses has gone in a complete blur and only now able to look back in hindsight (I know a wonderful thing!) I have no intention of starting a business, becoming a tranport police officer or becoming a school govenor, just feel am I being punished to harshly!! or is it what I deserve?. Have thought about fighting it in court, but recently feel like accepting the BRU because I cant take anymore and just want to get a job and start to contribute to society again - no more officialdom. The thought of borrowing any money either now or in the future sickens me.

should the OR be considering a BRO, I think that the essence is get everything up front and discuss the reason cause etc before it goes it is awarded.
Do not chase them for one, if you know its coming be helpful to them, they may be nice and award a lower term.

The OR is normally very thorough and has a lot of evidence in order for the BRU to be made but if you think the BRU is unfair then you have every right to argue the case in court. I haven't heard of one being reduced/declined but maybe some of the professionals on the board have. |
