Posted - 05 August 2010 : 13:54:23 I am failing my IVA due to I lost my job and now on half the wage that I was, once I receive my notive of termination of my IVA, I want to declare myself BR as soon as possible, just to get it all over with. I contact the co-op bank today to ask about the cashminder account and said that I was planning to declare myself bankrupt in the near future, and they said I could open the account now before I go BR. Is this correct? I thought that bank accounts were frozen when you go BR? Would be glad of peoples opinion on this.. |

Not true, the coop cashminder and barclays basic will not be frozen, I have both accounts and neither were frozen. |

Posted - 05 August 2010 : 21:16:22 thanks for all the advice above, I am hoping to go and pick up the forms to fill in next week from the local court, so will ask about which OR they may use and contact them, hopefully my termination certificate from my IVA will come through the week after |

Posted - 05 August 2010 : 19:12:11 There was only 1 OR office that insisted on freezing all accounts which was brighton, they dont do this anymore, have seen plenty of people recently at that office that have not had the co-op account frozen |

Posted - 05 August 2010 : 18:45:50 There are certain Official Reciever Offices that insist on Freezing every account some dont, I Would enquire with the court which OR office may be used and ask them if you are safe to use the account before BR, but you need to inform the Coop that you have gone BR and must inform the Official Reciever of the coop account and that they are happy for you to continue having it, thats why I said get a name so if the OR wants too they can contact someone at the coop.
The only exception is if you have a huge amount of money in the coop and their is no reason why you need it then the OR may freeze the acccount.
And with the OR some Courts book you an appointment some courts say the OR will ring you, mine rang me the afternoon of BR - im based in Liverpool

Posted - 05 August 2010 : 18:07:53 Hi Mike, I did contact the co-op again later today to speak to someone different to see if they gave the same advice. They said that I can open the account at anytime and start using, all I have to do is contact them when I go BR to let them know.They said they dont freeze the cashminder accounts because the account is just basic. So when you had seen the Judge, or clerk in your case, did they give you a number for the OR, or tell which OR to get in touch with? or do I have to find a OR before I see the judge for BR?

Who will inform my old bank to freeze my old account (I know they will close the account because I contacted them this morning and they said they cant provide accounts for BR) is it when you have been court to give your forms and seen the judge or is it the OR who does this? sorry for so many questions, just trying to get things straight in my head! |

Posted - 05 August 2010 : 13:59:59 Not all bank accounts or savings accounts are frozen, its at the discretion of the bank and/or the Official Reciever dealing with your case.
If I was you, I would open the account, take the name of the person who opened the account for you and put those details on the Bankruptcy form, and once you have gone BR then speak to your official reciever get his/her details and update the coop.
