I read accounts of people having their bank accounts frozen the minute they leave the Court. It is appreciated that we are not allowed to continue to use an account where you are in debt to the bank, but if you have set up an account (eg Co-op Cashminder) specifically to survive - ie for normal food shopping and essential priority bills etc - then obviously you hope that this situation can be avoided.
We are aware that you can ask the Judge to ignore the Co-op Account if it is there for day to day survival, but sometimes I gather there can be a 2/3 blip where the account gets frozen and then released again.
So, my question is *when* would any freeze take place? The Court concerned, when I phoned for some information, said that their OR normally writes to the creditors. I was assured that there was no electronic link to initiate immediate account freezing etc! We are not seeing the Judge until the middle of the Friday afternoon that leads into the Bank Holiday weekend.....
I am trying to avoid Direct Debits being refused that are due over that period if at all possible, so it is difficult to bolt this down and take appropriate action / damage limitation.

Posted - 13 August 2010 : 10:16:27 As of today (Friday 13) both bank acconts still working ok...on line at least. Coop are aware of my BR as Ive said...but Halifax (basic account ) are not. |

Posted - 12 August 2010 : 14:20:41 If coop Know that you are going Br and you have the right sort of account (cash minder) they are very supportive
they will not close the account unless you are sitting with thousands of pounds in the account.
the amount in account should be roughly the same amount as declared on petition.
If the account has been closed you will not be able to use the cash point machine so if nervous use your cashpoint card to check your balance.

I have two bank accounts...a Halifax account opened when I had an IVA...and a Coop account which I opened prior to going BR yesterday. I didn’t tell the court about the Coop account until they phoned me later in the day...they said its not their decision to close the account but the banks.... their job was to inform them I was BR. The Coop knew I was going BR but I took all my money out the day before. I am going to call them later today ( Wednesday) ...I will keep you posted. |

Hopefully then the Co-op Cashminder account will not be affected, but to be on the safe side we intend to have some cash for essential living just in case.

Where people usually fall foul is where they have an account with a bank such as Halifax or HSBC who wont have you as a customer. In that case it is the bank not the OR that freezes the account. The OR does everything possible to keep your essential funds available to you |
