Posted - 07 August 2010 : 15:44:28 Hello, I was repossessed over Christmas - I lived on my own - but I am now living with my mother in her council house - she is disabled and I am now claiming Invalid Care Allowance..I have no major assets. I got a letter saying I owe Santander an additional £20,000 following the repossession and sale of my house...I also had an unsecured loan for £7,500 - but they have turned this into £16,000...and my overdraft - of £941 which they want back in the next 7 days...
I am not bothered about my credit rating - I am on around £90 per week Carer Allowance - I want to go bankrupt - what's the best way to go about it?
The thing is - my mortgage was for £45,000 and I paid it for 2 years before getting repossessed - it was a Right To Buy property - I got a discount - it was valued at £69,000....I think the bank sold it for £45,000 to cover their costs - yet they still say I owe an extra £20,000....which I am never going to realistically pay.
I also have been threatened by the bailiffs for a £560 council tax bill...this debt will be paid off on Tuesday - my mother can cover the debt in this case....
If I go bankrupt - how long does it take? and would I be better using the £560 council tax money for the Bankruptcy cost?
Would I still owe this council tax if I go bankrupt?

Posted - 07 August 2010 : 23:24:45 Well the thing is - I am not classed as living here -it is my mother's house - she is on dialysis - so I only stay here 3 nights per week after she has been on dialysis because she is always very weak and drained afterwards with low blood pressure - so I claim carer allowance for looking after my mother for 35 hours per week...
So really - I have no possessions here - it is her house...so what can they take? Only my mother's things - but it is not her debt...
I am aware that these guys are b*st*rds in a lot of cases - the bailiffs...I have done plenty of research today!
Anwyay - the idea is to approach the council on MOnday morning to get them to call the bailiffs off...and make a deal to pay them £10 per week...
Of course - this gives me the time to claim bankruptcy...meaning I will only pay a small portion of my debt before the debt is cleared through bankruptcy...
It seems to me like it's big business in terms of people making money out of those going bankrupt / sorting out IVAs / etc....All over the internet!!!
The same with Stop Repossession....
I had to write 200 pages of copy for a "Sell Your House and Rent It Back" company...I must say that they did nothing but rip people off who were already having a tough time...
I had to word it as if they were modern day Robin Hoods! lol
Of course - it turns out that the managing director was a complete crook with his finger in several pies..he'd been to prison numerous times for fraud...I think he set up some cancer charity - where he kept 90% of the donations...and gave 10% to charity...lol

By the letter of the law they still have a right to send baliffs even during the bankruptcy (you dont have to let them in if they havent been inside already) for council tax with a liability order. Now I have only ever seen 1 case where they did this and most of the time the council call the debt back. But the possibility still exists and is something you should be aware of |

I've been awake for 48 hours - with so much to sort in one go.
I didn't stop to think that there are bound to be people going bankrupt who have a hell of a lot to fill out and attend to..
Obviously - some guy with 3 businesses and a joint mortgage going through a divorce with several assets is going to require £350 worth of help...lol
My case is damned simple to say the least compared to the vast majority!

Well - one thing - I was thinking about this council tax...If I can go bankrupt first - I won't have to pay the outstanding bill..
The thing is - I have the council tax bailiffs on the go now!
I owe £560 - even though I wasn't living at my house - they are charging me for the months after I left the property and gave the keys back...however - it's a lot of money for me at the minute...
This money could be spent on the bankruptcy - which would annul the council tax debt at the same time...
I need advice as to how to stop the bailiffs by going bankrupt...in a fast time frame...
I have about 10 days to act - do they have to back off if a bankruptcy claim is being processed?

Posted - 07 August 2010 : 18:31:55 I will answer your second question first. I do not offer any services and firmly believe that most people are quite capable of doing the forms themselves. Only people who have a very complicated financual situation or are very bad at filling in forms really need to pay for help.
The site is not just about making money and you can ask any questions on the forum free of charge that i and others will happily answer.
The OR will not take any household assets unless they are very expansive, think antigue furniture or paintings rather than TV's or games consoles |

Is that what this website is really about?
To get £350 off everyone who goes bankrupt by offering a service like that?
ie: Is this site just about making money?
I do freelance for an SEO company - copy writing, etc..

I have a computer...and a portable keyboard - I play music....it's not worth that much - would they take that?
It's hardly grand fraud if I leave it at my grandfather's house is it?
It's my only enjoyment in life..
Do they just want cars and things worth money?
ie: Large TV's / Home entertainment systems?
Or do they raid everything you have apart from the very basics...

Posted - 07 August 2010 : 17:44:57 Ok first thing is that you are required to get some financial advice amout your options before going bankrupt. You can pay for this and for someone to fill your forms in for you or you can get free advice from the CAB, CCCS or national debtiline and fill the forms in yourself or online at the insolvency service website
It costs £450 if you are on benefits, you will need to fill in a form for this and the bankrutcy forms which you can download or dt from your local court, you my have to book an appointment, so give your local court a ring and ask
