Hi I am going BR in two weeks time my wife has club debt which they are sending debt collecting around to see us but she has no income at all only my money whats worse they can do if we do spread sheet showing we can only afford £10 a month to it

If you are declaring BR in two weeks then it would be better not to pay the debt collectors. They are not bailiffs so cannot enter your property and take any items.

If you pay one creditor over another it is seen as favouritism and can get you into trouble once you are BR.

The options are:

1. Tell the Debt Collectors that you are declaring BR and will not be paying anything. They may threaten to take you to court, etc. but, if you are declaring BR in 2 weeks, they will not have time to sort out a court date/CCJ. This option is only worthwhile if you can stick to your guns and not be intimidated/threatened when they knock at your door. If you show any embarrassment about them being there or are worried about what the neighbours will think, etc. then this probably isn't a good option.

2. Ignore the debt collectors and don't answer the door when they come around. They are not allowed to discuss your debt with any one else so will not go and knock on your neighbour's doors and tell them they are trying to contact you over missed payments, etc.

If it were me, I would answer the door when they came to your house, politely tell them that you are declaring BR in two weeks and will not be paying the debt, and then close the door.

Are you definitely sure debt collectors are coming around? Most creditors will use this as a threat to get you to pay and there are some that will put a card through your letter box saying that they will visit at a certain time but don't actually turn up - this happened to me with a MBNA CC debt. The debt had been sold from MBNA to a debt collection agency. I ignored their calls and they put a card through my door saying they would visit at a certain time. I rang the debt collection agency and told them I was declaring BR the following week and they said they would update their records and that was the last I heard from them.
