 if my ex partner declares bankruptcy ?

if my ex partner no longer lives with me and has not done for 18 months but i still pay the mortagage on the property as I have been told his name cannot be taken off till next year, if he declares bankruptcy which I believe he is planning to do, will I lose my home even though ~I am paying the payments each month.

The key here, is whose names are shown on the proprietorship register at Land Registry for your property(i.e. who are the owners). Technically in bankruptcy who pays the mortgage is immaterial, as if your ex does become bankrupt, then the only thing the OR will look at is who the owners of the property are, and if your ex is shown as a joint owner, then it will be shown as an asset in bankruptcy.

In your circumstances, the best thing to do, is seek advice from a solicitor who deals with property, or from one of the experts in the housing forum who may be able to help.

One thing you didn't mention, is whether the property is in negative equity or not as this would have a bearing on how it could be dealt with.
