Posted - 15 January 2012 : 13:22:43 My (Estranged) wife and I have a joint mortgage. I now live elsewhere and am going to have to file for bankruptcy. I have app £13,500 equity in the home with which to service £40,000 of debts. Can the court force the sale of my home whilst my 2 year old son is living there with his mother?

The OR will keep an interest in the property for two years and three months from the date you declare bankruptcy.
The equity will be split between you.
I've no idea if the OR would want the house selling.
