Posted - 27 February 2012 : 23:31:37 Th property she is living in is in joint name with her and her husband names but he has never paid any mortgage towards this particular property. He also owns two other properties but to let, that were solely in his name. One of the properties were repossessed and had a loss of £30,000 and as result a charging order has been placed for both properties. She would like to know where she stands and how she can stop the charging order. She said he is in a debt management plan and the Principality Building society had originally agreed to the debt plan but there seems to have been a confusion and now they have sent a charging order for both properties.

If the property is in joint names, then the creditor can go for a charging order.
I suggest they speak to an expert to chat through the situation.
