Posted - 01 March 2012 : 11:06:41 Nigel is in arreras with 3 of his shops. One of them is owned by the council. He has been threatened with bailiffs and would like to know if they can enter into the other shops. He would prefer them to take the council shop but would like to know where thr council or landlords stand if he went bankrupt.

Posted - 01 March 2012 : 20:09:13 I assume that Nigel is talking about rent arrears. Landlords of commercial premises do have certain powers if rent is in arrears. These include distress where they can enter and claim goods within the premises in lieu of unpaid rent. Ultimately they can change the locks with the goods still inside. If Nigel declares hemself bankrupt, then any rent arrears will be included in the bankruptcy. However the official receiver will make a decision about whether any of his the businesses have any value and can be sold. I am also pretty sure that each landlord will seak to evict him. Nigel should not consider bankruptcy without taking further advice unless he is sure he wants to stop trading his shops and wash his hands of each of the premises.
