Posted - 15 March 2012 : 22:04:37 I have a joint property with my husband, he has a further 2 properties one of which was repossessed. The bank are now claiming a charging order of £31,000 on the property that is jointly owned. How can I protect myself as the debt is in my husbands name and I live in this property.

Posted - 16 March 2012 : 17:51:00 Thanks for replying he is allready with a company who are dealing with all the creditors they have allready paid one payment to principality building society before the application of charging order was made.He has a job and can afford monthly instalments the company are applying for the installment order to be considered at the time of hearing I am worried that I will have no choice for competetive motgage rate when I come out of the fixed term in March 2013 if there is charging order on the property.

Posted - 16 March 2012 : 07:50:04 Unfortunately the creditor can place the charge on his jointly owned property.
Can he come to an arrangement to pay them?
Does he have other debt? Is he struggling with his debts?
I suggest he speaks to an expert for advice as if he starts an IVA or declares bankruptcy before they go for a final charge, it will be overridden.
