Hi
Would I have to pay to have a CCJ set aside if a debt collection came after me due to the debt being sold on, not knowing I was bankrupt, and they acted in good faith. As I am not intending to clear up my credit rating/file as I dont want any credit again.

I was given some legal advice that if I did not clean up my credit file. (Declared Bankrupt 2008, discharged 2009). A debt agency could still buy up the debt and issue a CCJ against me for the debt, not knowing I had declared bankrupt. I would have to pay for the CCJ to be set aside as they had acted in good faith

The creditors were HSBC/Nat West and Barclaycard. I had been out of work for months, and offered to pay some money out of the job seekers but they were not happy with the amount. I had no choice but to go bankrupt. Will this come back to haunt me again? I had temped on and off when the work was there but am out of work again at 59. How much does it cost to set aside a CCJ?

Hi Angie,

Who was the original creditor? If it was pre-bankruptcy, then this debt should have been included in your bankruptcy and you do not need to pay it.

Hi,

I would have thought, and I could be wrong, that the CCJ would have been included in the BR and you wouldn't have to pay anything.

However, not sure on this at all so hopefully Viki will be along later to advise.
