I have recently become aware of someone who was declared bankrupt and has recently been discharged. Although I'm not aware of the exact circumstances, the amount of debt involved was huge (certainly the amount can be counted in millions rather than thousands).

The person concerned continued to trade as a different business (as a sole trader, no creditors so no issues there), but has definitely not been subject to an IPA/O despite boasting of profits of tens of thousands of pounds over the past year or so whilst in BR (whether or not this will be reported by him to HMRC is another matter).

My question is, is there a way to now complain about the conduct of a discharged bankrupt? (Obviously if he was still a bankrupt then a complaint the OR would be in order). There is also the possibility that his partner is also involved (not sure if she was also declared BR).

Please don't think that this is a spite or jealousy issue - it's just that people abusing the system like this make it far more difficult for those who are truly in need of the bankruptcy procedures in the future.

Hi Gary,

Please remember that just because he boasted that he made huge profits, he may have been lying!

If you think you have hard evidence and you have been wronged in some way, ie he owes you money, then you can search the London Gazette for his entry and find his OR that way.
