Posted - 12 March 2013 : 01:34:03 my ex wife lives in our hse (joint mortgage)which i havent lived in for over 5yrs.During this time she has paid the mortgage. There is approx 30k of equity. If i went bankrupt would the OR/creditors want a portion of this equity.My ex believes as she has paid the mortgage for nearly6yrs im not entitled to anything.Could they force her to sell the property. any help would be appreciated.Regards

This is always a bone of contention. The OR has to review each case based on its merits.
lots of variables that need to be discussed. have been able to show sucessfully No benficial interest after 2 yrs but am also in the middle of a set of arguments about a property / seperation 6 years ago !
so please get advice from someone in the industry (No disrespect to CAB but these arguments are beyond the every day training they normally receive)

Totally agree with Viki - give her a ring or visit the CAB for some free advice as to exactly what your position is.

It is very likely that the OR will say that you have a beneficial interest in the property.
