Hi, some advice if someone can offer it please. I am anticipating going BR around Jun next year. However, I currently have a legal claim in with some compensation solicitors following a RTA in which I suffered minor injuries. This case could easily drag into next year and after June. Please tell me, if I am awarded a settlement and I was BR at the time, could I loose this money even though it would be a payment for loss of earnings, injuries and distress? Thanks

I found this post from six months ago that I posted. I thought there had been a response. There seems to be a contradiction to this. A couple of experts from last year stated that if the compensation is for my injuries, then the OR would not be interested in the money. Only if the award was for loss of earnings. Sorry, I dont mean to start a 'he said, she said' but i do need to know. I would find it amazing if I lost the entire award a court could make for RTA injuries for pain and suffering to be handed over to the OR. It is therefore making me re-think a few things now.

I can confirm that the OR would only be interested in compensation from loss of earnings.

You seem confident I can keep any award for injuries. I appreciate the OR would be interested in any award linked to loss of earnings.

Hi acm,

As far as I remember, the OR would have a claim on your loss of earnings compensation, but injuries compensation would be exempt.
