Hi everyone,

My husband and I are due to go to court on Tuesday. We claim income support as a couple but it is in his name. Do we take our DSS letter as proof of benefits to court so that we don't pay the full fees? Will this letter be enough for me as it is in his name but my name does also appear on it? Can someone also confirm that the fees will be £345.00 each?

We don't have anyone who could lend us the money. My husband has called the DWP today and asked for an official letter stating that we BOTH get income support. Fingers crossed it will be satisfactory for the Court.

Hi Amanda,

Really sorry about your news today. Is there no-one who could have leant you the money? We claimed as a couple and needed DWP letters with both our NI on them, but as i said previously the standard yearly increase letters were enough for our court.
Get on the phone and organise these blasted letters then phone court for new date then have a good cry, i find this helps in any situation!

I am so sorry that you have has such c**p news today.

I know my court asked us to apply well in advance but we did not and have since just paid the full fee.

I do hope that you can rearrange the date for as quick as you can, i am sending you over hugs my friend.

Hi Tracy

Well I have called our local court and they have said that they need a recent letter (less than a month old) and that only he would get the discount. The woman was vague about what concession I would get. I don't get it as we claim as a couple. So now I have had to cancel tomorrow's appointment and get a letter sent to us from the Social. It has been such a pain...just when I thought it was nearly over!

Hi Amanda,

The court gives you the form ex160. My letters from the benefit agengy were dated April of this year, just the ones that say your benefit will increase ( pay rise!) and that was ok. We went BR last month. I think courts have diffrent ways so hopefully you will be ok.

Unfortunately we don't have anyone to lend the money from. I will just have to see what the Court says tomorrow. No use losing sleep over it...speaking of which, I'm off for some!

Hi i have some info on that in my blog under Help i cant afford the fees.

Have a little look and see if that helps you.

I think you may be able to print it off but my court i had to get one sent to me and filled in before the court date as it takes my court about 3 weeks to sort it out.

I still have not claimed back the fee.

Yes I hope so too. I was looking forward to finally getting it over and done with on Tuesday.

I notice that a few people have mentioned a form called a EX160. Is this a form from the Social or one I would complete at Court?

Hi everyone.

Thanks for all the replies. I now have to check what date our last letter is from. I have a bad feeling it is over a month old. We won't have the extra £150 to pay on Tuesday so now I'm really worried it won't go through. Does anyone know if I can take in a faxed copy?

Sorry forgot to say as i didn't have this on me at the time i had to pay the full amount but got the letter a couple of days later so got a refund,this is normally returned as a cheque so make sure you have a bank account!!! I didn't but the court made it out to my husband

When i went to court the letter of awards from the benefit office had to be within a month or else they wouldn't take it

Hi Amanda,

I have put the forms in for a refund of the fees paid by us and we needed 3 months bank statements and letters with both our NI numbers on and details of the benefits we received. Hope that helps.
