I am getting hassled by my main creditor the Halifax. I have told them that I am going bankrupt on the 5th of December and yet they constantly call me morning, noon and night, 7 days a week. We don't answer the phone anymore but it is really starting to bother me. What can I do? I know it's only 2 weeks until we go bankrupt but I am really cross about them hassling us. Last time I told them to stop harrassing me but it has obviously fallen on deaf ears.
Does anyone have any advice for me?

Posted - 24 November 2008 : 14:38:45 I think I am right in saying that creditors are NOT allowed to call you at your place of work. You can quote the Act (details above somewhere!) to get them to stop doing this.
The Halifax were by far the most annoying of our creditors. They have a system whereby they punch loads of numbers into their system (starting at 8.00 am even on Sundays) and they ring your phone until one of these numbers gets answered. Then it automatically tries your mobile number. My husband lost his temper with them so many times its untrue. You phone up and give one department details and it doesn't get passed to any other departments. Extremely annoying. In the end we unplugged our phone and asked family to call on mobiles.
It is a part of going BR that you unfortunately have to put up with but you won't have to put up with it once you have gone to Court (well, not for too long!).

Posted - 24 November 2008 : 14:21:17 When my main creditor starting contacting me at work, I gave them a call (Customer Services), asking them to take all my numbers off their calling circle - leaving only my mobile.
Fair play to them, they did that and the calls ceased (because silly me gave my old mobile number)! |

Posted - 23 November 2008 : 16:37:14 Thanks everyone for the advice. I will continue to ignore as many calls from them as I can and if I happen to speak to them just refuse to give them my details. A few of you may know that I was supposed to be going to court on the 11th of November but had to reschedule as I didn't have an up to date letter from the DWP. The Halifax actually called me on the 11th and admitted that they knew I was going bankrupt that day. I said "So why are you calling me?" They had no answers for me so I told them to stop calling and hung up. I was shaking with anger after that call and know that I will lose my temper with them if I speak to them again.
All I can say is roll on the 5th!!!

i was getting hassled by halifax too, they still would not accept that i was BR even when i told them my case number and gave them the OR's phone number. In the end one lady told me i had to ring another number there bankruptcy department. This was a month after going BR.
Just thought i would let you know ,so after you go BR and they try and ring , if you feel strong enough to talk to them ask for the number of the BR dept.
All the phone calls stopped as soon as i did this.

Posted - 23 November 2008 : 13:01:54 hi amanda, i can confirm this last bit of advice to be 100% correct, as my job that i have just lost i was a finacial seller ( haha thats a joke ) and when we called our customers, we had to by law confirm that they were indeed the customer, as we would be breaking the law re the data ptotection act, so just deny who you are !

John gave a really good bit of advice for this one. When you answer the phone to any creditors refuse to confirm your address and date of birth etc stating that you will only deal with letters because you can no longer handle the stress of telephone calls. If they continue to go on about the debt you then say to them that they are breaking the law by not confirming who they are speaking to. This certainly helped me before BR. After BR i threatened them with adminstration of justice act sec 40. Hope that helps

Posted - 23 November 2008 : 12:40:36 I know the situation well! I used to ask friends and relatives to ring twice then put the phone down then ring again. Can I ask why you are waiting for 5th december? Is it simply that you are waiting to get the fee together? Of course, Halifax will keep ringing you until the day when you can ring them with your BR reference number.

Posted - 23 November 2008 : 11:10:14 hi amanda, i have stopped answering my phone now and all my family and friends know that, so they leave me a message saying its them so i know, if you have caller display most companies show up as witheld numbers so just dont answer those withelds.

I would say its best not to write to them now as they are only trying to get there monies and seeing as yor not BR yet they will continue until you have the court no etc to offer them. You can mention when called the harrasment act but i think just leave it for now.
Try what i said about the calls and just try not to let it bring you down.

Thanks for the advice. I don't want to change my number but I could try giving them the wrong details when I do answer.
Do you think if I wrote a strongly worded letter stating that I am going bankrupt and that I don't want anymore calls from them, that it would do any good?

You could change your number, or when they call dont give them the correct details to verify you on the phone or give them a call and offer them a new number which you can make up and then when they try and call they wont be able to or you could get your provider to put a block on their numbers or stop with held calls failing that make sure you have caller ID and dont answer calls you dont know and let it ring and ring.
