I have a question about raising funds for bankruptcy and wondered if anyone could offer some advice? The only way I could raise this sort of money would be to stop paying my creditors for a month or two. Obviously this would mean them starting to phone me chasing payment until the bankruptcy goes through. I am prepared for that, however they also have my work phone number and I am worried they will harrass me at work. The only thing I can think of if this happens is to say that I no longer work there and give them a false name. Is this legal? From past experiences, when I have missed one months' payment, my creditors do seem to chase it up pretty quickly by phoning, etc and pressurising me to make an immediate payment. I also have one creditor who is payed by direct debit from my bank account, so I am thinking of cancelling that in order to save for the bankruptcy fee. Does this all make sense or should I find another route?

Posted - 24 November 2008 : 17:10:04 One way of reducing the heat is to make a token payment of £1.Whilst many creditor grumble most will accept the payment.
With respect to telephone calls at work, most employers don't allow you to make personal calls. You could tell the creditors this and thatby making such a call they are in breach of section 40 of the Administration of Justice Act 1970-An act which defines debt harrassment-which calling you at work clearly is :-( |

this is a very common way to finance your BR. You will, as you say, no doubt get phone calls but it is not legal for the creditors to hassle you at your place of work. That doesn't mean they won't, it's just not legal for them to do so. Tell them what you like if they do call.
If you do not intend to pay creditors they must all be treated the same so you should indeed cancel the one which is currently paid by direct debit.

im no expert, but i am hopingto go BR too and i have stoppoed ALL direct debits and payments to everyone except the utilities, i will hopefully petition in january.
