Thanks Paul ill ring orange tomorrow to get it cleared in my head once and for all, in the end of the day, if they cancel the contracts I dont want the debt to be paid for it would be best for it to be absorbed in Bankruptcy

Hi

Sorry been preparing some court documents.

The OR will make an allowance for phone costs - usually arround £55 per month. If you chose to use this on mobile rather than landline then it believe that is fine.

I am however reasonably confident that if you push your luck and ask loads of Q's to the provider then you will be on PAYG quicker than you can get the new sim in the phone.

My thoughts are that if you are not in arrears then they are not a creditor, and provided you don't take out £500 of credit or more then you are not breaching the terms of the bankruptcy .

I am however not sure how the £30 per month for the brodband would be regarded. I assume you didn't sign am HP agreement , so technically not a debt, so provided you claimed the £55 for phone services and made up the difference from your personal allowance I think that would be fine.
