Posted - 21 January 2009 : 21:54:02 I have decided to go bankrupt and have a few questions before i do this. Firstly i have a car. the book price on this is £1440. It is playing up and we are wanting to trade it in to get a different car. obviously we would rather put the new car in my husbands name and register it to him. my question is that if i do this before i go bankrupt will they ask what happened to my car? if so then if i get my husband to pay my rent etc to the value of the car then can i just show then that this is where the money went? My other question is that somebody called to my house re my council tax last week. a liability order was issued months ago but this is the first contact i''''ve had since. i did not let him in and he did not ask to be let in just gave me a letter with a number to call to arrange to pay. What will happen if they come back and i do not let them in. can they apply for entry and if so how long will this take as i don''''t know how long it will take to fill in the forms and get the appointment. Also is there anybody you can get to help filling in the forms who don''''t charge? Thanks! |

Posted - 28 January 2009 : 19:12:17 it was definately a baillif i checked the paperwork he gave me. i was also charged for the visit and there was a leaflet about how much baillifs can charge for visits. will it go back to court if i don't let them in? |

a bailiff is not permitted at anytime to break in. I'm also not sure that the recent caller was a bailiff. Fom your post I would suggest it was a debt collection agency.

Posted - 27 January 2009 : 21:34:46 I wasn't planning on letting the bailliff in to get a walking possession. if you don't let them in how long would it take and can they gain entry by breaking in? |

Paul is spot on (as usual) about the car.
If the bailiffs come back, you will be asked to sign a Walking Posession whereby the bailiffs officially take ownership of your posessions, but leave them with you whilst arranging a payment schedule. As these are Certified Bailiffs, it is not uncommon for them to insist on 50% now and the balance in a month.
I would recommend talking to the council about a payment schedule as only they can call the bailiffs off now, unless you have grounds to contest the debt in court with a view to suspending the Warrant of Execution.

you will need to give details of cars owned & sold within the last 2 years, so you will also need to identify what you did with the money from its sale

Posted - 22 January 2009 : 01:00:23 HI Steph Not sure if i missed something in your post but if you put new car in husbands name and hubby is not going br then i would have thought you neednt declare youve ever owned a car.
2nd point i would give them a call and offer to pay a pound a month to get them off your back until you go br.
And 3rd before doing anything i would give the experts on this site a call.
We paid someone to do our forms and i reckon if id found this forum earlier i would have found all the information i needed to do our own forms.
