Hi I am intending to declare myself bankcrupt and have defaulted on my IVA. Change of circumstances. I am waiting for a letter or certificate from the IVA company so I can go ahead. The IVA are ignoring all my letters not even any acnowlegement of them. I have had a letter from them threatening bancruptcy. Can they put a sudden stop on my SOLO bank account ( cash account not a full bank account ) as the money in the account is my bancruptcy fee. My state pension is now paid into this account. My utility bills are paid by direct debit from this account. I have no other income. Should I take the £500 BR payment out of the account and keep it at home in case.

They cannot touch your bank accounts as they do not have the authority in an IVA.

Sorry, the reason i said open a new account was just incase and if it made you feel better, you dont have too of course. You should be ok but if you felt that they may try it on you could change banks.

Why open a new account? is it because they will have no knowlege of the new account and therefore can not have any access to it. also I can use my solo card on line for shopping etc. I have not seen the coop account as able to use on line. I have only just started receiving my pension this week and it has taken ages to get that sorted, it was late being paid. If I can help it I don't want to start changing things yet for a bit. Sorry to sound like I am being a little awkward. If one of my creditors decides to BR me would I get any notice of this. I dont know why they would bother though, I have no car, live in rented accomodation and receive state help to pay rent and council tax. Surely the only one that can put a stop on my bank account would be the creditor taking out a BR against me and not the IVA company.

No they should not be able to put a stop on your account but i would if i were you open a coop cashminder account and pay your pension etc in there.

They are dragging there heals arent they.
