Posted - 24 January 2009 : 14:50:56 If a relative was to buy a car from a person who is going to go BR in the future, and bought it for the guide price (less than 2k).
The BR person used the money for BR fees and living exspenses etc. Could they then agree to buy it back from the relative for £50 a month and include this in their essential expenditure along with petrol, maintenence etc? Could you answer twice, 1 if the person needed the vehicle for work and the other if they didn't.
Second question is, if you say you need a car for work, what does the OR do to find out if this is indeed true?
If you don't need a car for work but use one (you buy it after BR or something like that) are you allowed to claim any essential expenditure at all for it? |

how would you buy a car as an undischarged BR when if you have DI the OR takes it in the form of an IPA?
In any case, if you are deemed not to need one then you would not be able to claim running costs.
You would be able to claim essential travel costs (essential journey's) equal to the sum of the public transport cost but there would no point explaining that actually they are petrol costs.

the answer to your first question is the same whether the vehicle can be proven as required for work or not. I'm afraid the answer is no. The OR will not allow a £50 payment per month for the car. However, to sell the car as you describe for the true value is fine. To use the funds as you describe is also fine. The vehicle details could then be entered under "do you have use of a vehicle you do not own?". You could also then enter the running costs against expenditure but only if it is proven that you need it. Once you are discharged from bankruptcy then you could buy the car back without problems.
Re your second question:- The OR could look at where you live and where you work and the practicalities of using public transport between the two. If you live rurally and there are limited public services then you may get to keep the car. If the expenditure required to travel exceed the costs of a car then you may get to keep it, if you work shifts etc etc.
