We own a frnachise and today had a treatening phone call from the franshicor saying that he was comming to see us as he had heard we were going bankcrupt and that he wanted to see us face to face as we owed him money, and made some allegations saying we had not been putting bills through the system and were pocketing the cash.
We are so scared, we told him we would arrange a meeting for the 17th Feb the day after our BK to bide us time however he said he was getting on the next train to see us today and if not he would come and see us tomorrow, where so scared as they are knon for not being the friendliest fo people and also were scared that the allegations he is making up could get us into serious trouble.
We phoned the court and they cant do anything earlier till the 11th Feb and thats the soonest so took that date to get this over with fast.
What should i do as he keeps phoning, and were scared.

Im so sorry to hear your situation with this person - this is all you need at an already stressful time.
Im not sure if you managed to contact anyone at the helpline, however if you look at the post entitled HELPLINE then you can email and someone will get back to you.
Alternatively could you not call Paul Johns at Reviva or email him to contact you, as he is usually available most of the time.

if it's in the contract then this clause could well be invoked.
If the property is in your name (lease) he cannot enter without your permission and he would need to have a CCJ made against you prior to bailiff action. He doesn't have time to do this.

Posted - 27 January 2009 : 16:06:38 Should I admit that Im going BR. I go to court 11th Feb and in our franchisee agreement he has the right to make us cease trading with immediate effect if they think this is the case and also if he does this then we wont have enough to pay our court fees etc.
also could he get balifs to come to the shop and remove things if he does make us shut ? |

the first problem of course, in light of the company's reputation, is that they found out about your plans for bankruptcy.
I doubt there is much can be done until this guy breaks the law. Coming to see you for a chat is not unusual in a franchisor / franchisee situation so it's difficult to see why the police would justify attending your premises unless a law is broken.

Sorry to hear of your dilemma.
I Take it this guy would become a creditor in your br. If its not a massive amount couldnt you tell him you will leave him out of your br so he will get back every penny,and then include him in the br anyway.
In my town you can just turn up at court 11-3pm mon-thurs to declare br although i think you have to go back early next day hope this is to see OR We are going br next week.
hope everything works out for you dont know what else to suggest hopefully someone will come up with a plan thats perfect. |

Posted - 27 January 2009 : 15:00:18 If you are scared it is harasment & you have the right to police assistance. If you know you have done nothing untoward then the franchisor can threaten all he likes!!! |
