Posted - 10 February 2009 : 11:21:44 hi can anyone help me? 1 was declared bankrupt 23 jan 09,as soon as the forms came through i rang the OR office about my bank account. as this is a basic account with the nationwide the OR secretary said she would fax a letter to them to say it was ok for me to use it. Yesterday as I tried to draw out the income support i found it is froze. I again got intouch with the OR office who informed me they will get onto my bank but put a restriction of that if i withdraw more than £200 to let the OR know, all we have is benefits, however i am severley physically disabled so my DLA goes in and my son has aspergers so his DLA goes in he is only 13. Does this mean i can only drawout £200 a week, dont really want to ring OR office again. or if i rang my bank would they tell me.

hopefully the OR will sort the account out with the bank very quickly. The withdrawal restriction only asks that they be informed, for the moment, of total withdrawals above £200 in any one week.
This does not mean that you cannot do so, it just means that the OR may ask what the monies have been used for. As long as they have been used for essential needs as listed on your SoA you will be fine. Once the OR is satisfied that there is nothing within any of your accounts beyond that which meets the costs of your essential expenditure I have no doubt the restriction will be lifted.
It is just a precautionary measure, as you are newly bankrupt, to ensure you are not attempting to syphon off funds. When the examiner looks at your case file then it is easily established that this is not the case.

Posted - 10 February 2009 : 11:34:46 Ring the OR's ask to speak to the Examiner you originally dealt with explain your problem with them, you should not have any difficulties in access to your income whether wages or benefit based. This income is benefit based and therefore not looked at from an OR position re income & expenditure therefore ask them to release the account so that it can be operated in a 'normal' manner
Hope this helps, sorry it means having to speak to the OR but they are the only ones who can 'release' any restrictions placed onthe account - the bank will usually operate as instructed by OR
