Hi again

Can I just confirm as I know this is a fairly recent topic. I have declared on the SOA under s.13 Additional Information, that at some point this year I should be receiving injury compensation following a RTA last year. There are no loss of earnings as I have already been paid out for that several months ago. Unfortunately, my condition has deteriorated and my GP has told me to give up my driving job as it is making my conditions worse. I have not done so as I need to earn a living. I am shortly going to see a consultant and there is a possibility I could lose my business through this and will therefore be seeking damages for that too. To get to the point. If none of the money awarded in the settlement is down to loss of earnings then would I be allowed to keep the entire award be it substantial or not? And secondly, do I need to declare this on the SOA at all if the award is not earnings related.

Many thanks, Andy

any monies other than loss of earning would need to be stated to the OR and you run the risk of the OR requesting them for the benefit of your creditors (this is for the whole of the bankruptcyperiod - the the payment was received after discharge it would be yours to keep)
