Hi,
This is my first post so hope i've done it right.
We need to go bankrupt but situation is quite compplicatred due to some incredibly poor choices. Any help would be greatly appreciated.
My husband and I have approx 50k unsecured debt
Last year our house was repossessed and we are now nearing the end of a rental agreement.
We should have gone BR at the time our house was repossessed but could not afford the fee so instead we moved, did not tell any of our creditors and as a result we have had no contact from them or many any for of money for nearly a year.
How would the OR view this, can we still go BR when we have no ides of balances and have no statements for any of the debts?
Also is there any way of getting yourself made BR and therefore avoiding the fee? We have significant council tax arrears, have had bailiffs visit who agree that we have no assets and need to go bankrupt but so far they have not done anything about it!

Hi

don't worry about the apparent avoidance of the creditors over the last year or so.
This will not be an issue as far as the OR is concerned as the important point is that you are dealing with things now. You will however have to at least give a list of creditors or the court willl likely refuse your application.

Write to one of the credit reference agencies for a credit report. The reports only cost £2 each and will give you the details you need.

Any creditor owed £750 or more could petition for your bankruptcy but these days it's unlikely unless they know there will be a financial return, from the sale of a property with equity for example.
I'm afraid they are more likely to continue to hound you (if they knew where you were)until you do it all yourself.
