Posted - 16 March 2009 : 21:12:35 Hi, I know I have asked this but cannot find the thread.I am sure Melanie responded but cannot see the answer about either letting them know myself or letting the OR know. I have filled in my SOA on line and now submitted it in my current address as I have not moved out yet. I have my court date booked for 7th April and obviously I will tell them then my new address. I have secured rented property for which I will be getting the keys this Friday, 20th. I have listed my mortgaged house as an asset and the mortgage in the secured section as well as including the anticipated shortfall in the unsecured section although I intend to voluntarily surrender it. Is it better to wait until I am declared BR to tell the mortgage provider that i wish to "give it back"? or can I tell them now? I am not sure if giving an "asset" back could be seen as preferential to the mortgage provider over and above my other creditors even though the house is in negative equity?

this is not preferential as it is secured borrowing. Inform the OR that you no longer live in the mortgaged property and that you do not wish to keep it. You may find the OR will deal with everything including informing the mortgage lender.
