Posted - 29 April 2009 : 16:31:43 Hello, I have lost my business of which I was a sole trader, I am not working at all. although I am looking, I now owe lease companies for photocopiers, and banks alot of money, and utilty bills for the business around 100k in total, I own my home which I own outright which is worth about 90k as it a mobile home, I live with my partner and son. all the relavent companies are asking for payment some say £10 for now will do, I suppose to show willing. although I suspect that wont last, what should i do to address my situation, I am an honest person, should i let one of them take me to court and put my case to a judge and tell him what i can and cant afford, or should I make myself bankrupt? taking into account I dont want to lose my house. |

As you can imagine I have no means of paying for advice, and my case no doubt it would need a fair amount of time spending on it to get the expert help I need. I wouldn’t expect anyone to take it on, without me being able to pay for it. It’s a catch 22 situation.

you definately need a plan and definately need some solid advice regarding the way forward.
We have significant experience with the photocopier industry and understand the jargon and the challenges of working within the business.

Posted - 30 April 2009 : 11:47:01 Hello again, thanks for your reply Paul, my business was a photocopying company, and yes they have all collected the equipment, but are also asking for the balance remaining, on all three machines. I have no tax problems pending although I did have but that has been resolved. the original cause of the business going under was the bank frooze my account as they considered my overdraft was too high. and the business went into free fall when leases went unpaid, the business lease has been surrendered back to the landlord. so im left with many requests for payments from many sources. I think im asking firstly, if i manage to pay each one a small amount will that borrow me time, or will they get more pushy, and drag me into court? or what is the worst for me in trying to fight for my home, make myself bankrupt ( i assume i would lose my house (mobile home) anyway) or wait until someone attemps to make me bankrupt, and will all my dept be included? and argue my case in court, but of course I'm guessing here.

you need to get specific advice relative to your individual circumstance.
have the finance companies actually reposessed their goods or do you still have equipment etc. What type of company did you run?
