Is it possible for a British person living in South Africa to declare themselves bankrupt in England. The debts are British however he doesn't have a proper British address any more and has no income (trying to set up a business in Africa, lives with his parents). He isn't planning to come to back to Britain anytime soon but could come back for "a holiday."
Or would he give power of attorney for someone to petition on his behalf?
If he can't declare himself bankrupt what will happen to the £38,000 of debts he abandoned in the UK?
What questions should I be asking? |

The court costs for the High Court have increased to £522 from the brginning of April.
Just a reminder so nobody is embarrassed ont he day.

You should contact Reviva UK as they have experience of assisting people living abroad.
I haven't heard that you need an address in the UK but you would need to petition in the High Court, London. You can just turn up on the day with the forms and £510 and there shouldn't be any problems.
The other (more expensive) option is to assign someone to represent you with a Lasting Power of Attorney. |

I'm in the same boat as you Johnny118. Only been in the UK 6 months out of the past 3 years and don't have a UK address after tomorrow.

Do you know what the process is for declaring bankruptcy from overseas?
It says under the information tabs on the left he needs a UK address.
What is the best way round that?
I assume the bankruptcy would be registered to that address.

Hi,
As long as he has lived over here within the last three years, he can declare bankruptcy in Britain. He can either come back across and do it himself, or appoint a power of attorney to do it for him.
