Posted - 01 May 2009 : 10:45:26 Is it possible for a British person living in South Africa to declare themselves bankrupt in England. The debts are British however he doesn't have a proper British address any more and has no income (trying to set up a business in Africa, lives with his parents). He isn't planning to come to back to Britain anytime soon but could come back for "a holiday."
Or would he give power of attorney for someone to petition on his behalf?
If he can't declare himself bankrupt what will happen to the £38,000 of debts he abandoned in the UK?
What questions should I be asking? |

I haven't heard that you need an address in the UK but you would need to petition in the High Court, London. You can just turn up on the day with the forms and £510 and there shouldn't be any problems.
The other (more expensive) option is to assign someone to represent you with a Lasting Power of Attorney. |

Do you owe anything to Amex? They seem pretty good at making their ex cardholders BR |

Posted - 01 May 2009 : 15:09:16 Thanks for that. It sound quite hopeful. Do you know what the process is for declaring bankruptcy from overseas?
It says under the information tabs on the left he needs a UK address. What is the best way round that?
I assume the bankruptcy would be registered to that address.

Posted - 01 May 2009 : 14:38:53 Hi,
As long as he has lived over here within the last three years, he can declare bankruptcy in Britain. He can either come back across and do it himself, or appoint a power of attorney to do it for him.
The glimmer gets brighter all the time
