Posted - 03 May 2009 : 08:44:04 hi my husband and I are currently bankrupt we have been put in for early discharge and i hav a expenditure form to fill in,we are living off benefits we get income support, child tax and child benefit, also i get carers allowance and disability living allowance for my little boy who has cerabral palsy. can any of these benefits be taken away to contribute towards our debts? i am really worried.

Posted - 03 May 2009 : 09:13:21 According to the OR Technical Manual if your ONLY source of income is benefits (and some are not means tested anyway,ie.DLA and CB) then an IPA can be suggested if there is surplus income but you can say no and NO ENFORCEMENT action will be taken.
