Posted - 03 May 2009 : 21:34:55 I went BR on 28 April, after seeing the Judge I got the court paper that says I am now BR and I had to speak to the Receivers office on the phone straight afterwards.
I don't know who my receiver is and have heard nothing else, I had 31K on debt and I'm on Income support and DLA.
My car which I need for myself being disabled and my disabled Mum and grandfather who is going blind is a only worth under £400 its a T reg, will they want to take it?
Can any of my creditors take legal action against me?
My cards are now having fines applied and my accounts have not yet een frozen, I don't understand? short I send copys of my BR letter to the creditors?

Posted - 05 May 2009 : 18:15:31 If anyone rings Ben just tell them your now BR and quote them your BR Ref number and that you wont be making any payments from now on. |

Posted - 05 May 2009 : 18:14:52 The next time they call give them the BR ref number as it can take up to 4 weeks for the OR to send the creditors the BR certificate. The other option is to post a photocopy to your creditors yourself.
If you are on benefits then it may well be the case that you do not hear from the OR again as you will not be liable to an IPA and no additional information may be needed by the OR to see how you got into difficulty. |

Posted - 05 May 2009 : 17:41:07 I have just had a call from one of my creditors about my Direct debit that has been canceled. I was advised to do this by the CCCS counsellor. They have asked me when I will be able to make the payment so I said next week, should I have just told them i've gone BR last week. Its just that i haven't heard anything from my receiver and as above, I don't even know who or where he/she is. |

Posted - 03 May 2009 : 22:18:37 Glad court was ok for you Ben, my Judge was equally nice although I was "flashed back" 30 odd years to being called into the headmasters office. At least the Judge did not have a ruler!! You may be too young to remember those days. Hold on in there Ben, it is the start of the new financial year and everyone is so busy. If you have not heard anything in a week or so give them a ring. They won't think you are hassling at all. All the best.

Thank you for your kind welcome, I had been having a look through what other members had said today and agree that many people had said there OR was not judgemental and helpful, I certainly hope I have the same reaction.
I was expecting the Judge to be judgemental and a bit on the nasty side as a form of being told off so to speak. But he was very kind and considerate, he even thanked me!

Posted - 03 May 2009 : 22:04:40 Hi Ben, Welcome to the forum. You will find this site massively helpful. I am a mere novice but can tell you that you will find that it will take a while for the OR to notify everyone. If you have creditors contact you just give them your BR number and say "My OR will be in contact". You will find they stop phoning you eventually, I went BR on 7th April and still get calls. It depends on your bank account and if debt is attached to it the OR will freeze it but with my account he said no interest cos no debt attached and it is my bank for my salary etc. so hopefully it wont be frozen. Your car should be safe because of its relative low value but hang on in there the OR will contact you and you can tell them everything and they will guide you through the process. Many people on this website will tell you that their OR is not judgemental and as long as you are honest and don't try and hide things you are fine. Good luck.
