Hi there I am self employed and earning very little at the moment hence my filing for Bankruptcy, I have nearly completed the online form however I am stuck on a couple of things, in section 6 income; I am married but my wife is also self employed and out of work at the moment so not really contributing to household expences should I just leave it blank for now? Also we are living at a family home and we contribute with cash when I earn it. Our rent should be £450.00per month which I have put as £225.00 for me to pay and bills are paid for when they come in, however there is no contract to prove that as it is a family member. Will this be a problem when it comes to proving it? Last but not least are there certian amounts I can put into my outgoings that I am leagally intitled to put? Sorry if this is jumbled questioning, I am slightly confused with it all and just want to get it right, I have been to the CAB but their help was very basic and it takes to long to get an appointment. Ihope you can help thanks, Brett.

Hi Brett,

Don't worry about asking questions as there are lot of people who can help you on this board.

Is your wife declaring BR as well or just you?

With section 6 this is your income as well as any tax that you pay. If your wife isn't able to contribute anything at the moment then put £0 down for her. This should be the amount you earn, the amount of tax you pay and the amount your wife contributes at the time you are declaring BR. If all of those figures are zero then that is what you should put down.

The OR will go through the figures during the interview and it is not a problem if your circumstances change between submitting the SOA/declaring BR and having the OR's interview.

"Also we are living at a family home and we contribute with cash when I earn it."

Does this mean you live with your parents/your wife's parents? If so, do not feel obliged to say that you are paying 50% of the rent on the SOA; just put the average that you have paid over the last 3 months even if it is zero.

"Our rent should be £450.00per month which I have put as £225.00 for me to pay and bills are paid for when they come in, however there is no contract to prove that as it is a family member. Will this be a problem when it comes to proving it?"

No, this will be fine. The OR will ask for bank statements for the last 12 months and you will be able to tell her, which direct debit/cash withdrawl is for the rent. She may want to contact the person that you are paying the rent to just to confirm that what you say is true and whether there are any arrears/monies owed but it will be fine/

"Last but not least are there certain amounts I can put into my outgoings that I am legally entitled to put?"

There is nothing that you are legally entitled to but the normal things are rent, gas, water, electricity, food including cleaning goods, clothes, telephone including mobile, house insurance including contents, car insurance/MoT/servicing/breakdown/petrol, dry cleaning if you wear suits to work, traveling to/from work with public transport and depending upon the amount of money left over and the OR, haircuts and a UK holiday. There are also additional items if you have children.

You can always post your I&E up here and we can take a look and let you know whether you can add additional items/expenses based on our experiences with the OR.
