Posted - 01 June 2009 : 20:29:39 Hi as you will see from my postings myself and hubby went BR in nov08. Have recently filled out forms for early discharge and today hubby recieved IPA for 450 per month, which we think is really steep. How do we protest this with OR. Also do we have to inform him of pay rises and bonuses during 36 mnth period, and how much is he likely to take of us.What happens also duering this time to any windfalls does the OR still have a claim?? even when discharged??

I've photocopied everything, the OR told us initially we could keep the car even though we pay 135 per month he had no interest as hubby needs it to get to work [ providing finance co agreed which did] , however,... whoever worked out IPA has also not allowed this, and out of DI left over this payment would be impossible.
Will let you know how we get on, am sending a bundle of bills etc with a lonng letter tomorrow am reg post!!

Posted - 07 June 2009 : 13:48:15 Send the OR the gas, elec and water bills to show that these are the amounts that you pay and he will have to accept them even if he thinks they are too high. Do the same with the insurances.
£500 food is normal for 2 adults and 2 children but school lunches should be separate.
If the school bus is a necessity then this should be allowed as well.
It sounds like the person who did deal with the I&E just went straight from the recommended expense levels without discussing it with you.
Once you provide evidence of the costs and advise the OR about the school bus/meal situation then it should be ok. |

Posted - 07 June 2009 : 10:39:11 Hi Deedee, Thanks for reply we have recieved breakdown, OR said to send it back with comments and reasons etc which we will do. He has allowed £40 for all insurance, our contents is 26, life assurance for mortgage 52, and pet insurance 35!! He also agreed we could keep our car on finance as we need it to work yet hasnt allowed us monies to pay for it a month, he has disallowed 40 per month school bus which is a necessity. He only allowed 500 housekeeping for 2 adults and 2 children which also covers school lunches, so am going to ask for increase in this. Also i pay 90 gas he allows 75, i pay 100 elec he allowed 75, and i pay 70 water he allowed 40!!!??? I think he has slashed everything we put down to try and get as much DI as poss to enforce IPA, but when i questioned him he didnt seem opposed to a challenge??!!
Im quite happy to pay IPA but at present am only left 190 per month to top up house hold bills, pay car finance, school lunches xmas birthdays, etc and cover food when 5 week month falls, my concern is we will end up back in the red at square one.
Any advice appreciated.

Posted - 06 June 2009 : 23:48:30 If the IPA is set at 70% then they will take 70% of the bonus.
If you get a pay rise after you are discharged then hypotheticaly your contribution to the household will increase but it is up to you and your concious whether you tell the OR or not because unless you tell him he won't know.
Ask your OR to send you a breakdown of what he has and hasn't allowed on your DH SoA and then post it up on here and some will check it over for you to see if the OR has made a mistake, which is not unheard of. |

Just one more thing if I dont get an IPA, do I still have to inform them of my pay rises over the next 36 months, even when I'm discharged and IPA in hubbys name?? [Trying to decide whether its worth me increasing my hours or not, its not that we dont want to pay some monies back but I cant see the point of working extra for no return]!!! If hubby got a bonus during 36 months period of IPA [after discharge] do they take a cut of that and if so how much??
Sorry to ask so much but belive it or not have just rang ORS office and they cannot answer this??? Have to ring am and ask chief examiner!!

Yes, you can negotiate, and ask them to go through the expenditure with you to discuss why they have reduced it. If you have a figure in mind speak to them about that, as they may be happier to accept that than get into to lengthy discussions.

We thought we only had about £112 DI, so to come to these figures he must have slashed everything!! Can we challenge this and if so how, are we entitled to see his figures on how he came to this amount?? Is is ok to suggest a figure we feel we could comfortably repay without getting to near the bread line again? Sorry for all the questions but I havn't slept again last night and neede to resolve this asap.

frim your figures the OR has assumed that you have 642 disposable income each month and because it is over 500 they will take 70%.
you do have a duty to inform the OR of changes ( increases and decreases ) to income plus material changes in circumstance such as changes in job, address etc.
the windfall issues ceases after you are discharged from Br even though an IPA may still be in operation
