Hello... Am new here and have read a lot of the posts which I have found very helpful. My husband and I are on the end of the line and we just dont know the way forward. Our strings of debt started of 6 years ago then it got worse over the years but last year and this year has been the worst... I owe around 10K in loan and credit card debts and my husband owns around 18K in loans and card, I mainly manage the money or lack of it and has been trying to pay one loan with another and at the same time still live life. We were already in a desperate situation around September last year and we can barely meet the minumum payments then luck just wasnt on our side. My husband got redundant, I had to stop work due to a fractured knee for a good few months, we had to move because the landlord had problems with the house that we were renting. During those times, we use our credit cards and has been fooling ourselves that when things get better we will be able to repay it so things just gone from bad to worst. My husband got another job but its not enough to even cover the minimum payments. We just got tangled, we applied for a loan last february in a dire attempt to manage to pay the minimum payment and still manage to live... but we had an emergency and had to fly back to my home country so we used up my husbands credit card and part of the loan. It is something we had to do due to personal family reason and it wasnt a holiday. We only went to my home country for 10 days and that includes a 56 hrs flight there and back so it wasnt a holiday at all.. I am scared what the OR will think of this. anyway, my point is we are stuck now, we have used up all our credit facilities and we cant afford to meet even the monthly repayments... I just dont know what to think anymore. Any advice would be appreciated.

P.S.

In my calculation we are in deficit by £700 a month. Were just sinking and sinking...

If the amount you owe is less than £15k then you could apply for a DRO rather than BR. This is administered through the CAB so you should give them a call.

BR sounds like it is the best option for your husband (and you if you owe more than £15k) but you will need to seek professional advice on your current situation as this is something that the Judge/OR asks. This is to make sure that you are aware of the implications of BR and so that you are made aware of the other options, if any, that may be open to you both.

You can get advice either from the CCCS, CAB, National Debtline or by selecting the 'experts' link on the left hand side of the page to speak to one of the professionals that frequents this board.

The loan 'may' be questioned as it was taken out so close to BR but the OR will understand about the money being spent on travel for a family emergency.

I think BR might be a good option for you both. I doubt the OR would be bothered if it was for a family emergency
