Hi again, thanks for the previous support you offerd it really did help. I now have a date for my bankruptcy hearing, would it be possible for some one to advise me on what to expect on the day and after when the officail receiver take over my case. Also I have banks and credit cards calling me for outstanding monies owed, now on a daily basis, my court date is not for 2 weeks, should I just take the calls and be honest and tell them I am filing for bankruptcy? will they then file a claim agaist me? I am just trying to not over complicate things for myself as it is stressfull enough already. Thanks, Brett.

Hi,

You can either tell the creditors that you are declaring BR and then ignore then or just ignore them and don't bother telling them. I told my creditors and then just didn't bother answering their calls.

The creditors won't file a claim against you so there is no worry there.

Courts operate slightly differently but what normally happens is on the day you are BR or a couple of days after you will speak to the OR and they will run through a couple of things advising you that they will send a pack out to you, they may call you to arrange an interview or the details may be in the pack, etc.

When you have your interview the OR will go through your SOA to confirm your creditors and to try to understand how you became insolvent. They are not judgemental and your situation won't be anything they haven't heard before. They will also go through your I&E and advise whether an IPA will be applicable.

Once you have had the interview the OR will only contact you if they need more information regarding your case. If an IPA is applicable then they will send you a document to sign saying that you agree with the monthly amount.

Other than that there isn't really much to it. It's just a case of putting the past behind you and getting on with your life without being bombarded by calls from your creditors and worrying about how you are going to pay them.
