Hi again,
I finally filled the forms out and submitted them to the courts I am now officially BR, I have just one more question can the OR ask to see my wifes account? she is not bankrupt and it's not a joint account, the reason I ask is because my joint account has an overdraft that I took out, (my wife did not even know about it) but the OR says my wife will need to pay it off and when I tried to explain that she did not know about it she asked to see her account is this correct? My wife does not want to disclose her private account to the OR.

Thanks

That's right - any joint debts (including overdrafts on a bank account regardless of who has run them up) are down to both of you. As you have now gone bankrupt your wife will be chased for the whole amount as you are both jointly and severally liable for these.

The glimmer gets brighter all the time

Hi,

"she is not bankrupt and it's not a joint account, the reason I ask is because my joint account has an overdraft that I took out"

Are these two different accounts? You mention that your wife isn't BR and it's not a joint account but then say that the joint account has an overdraft on it.

If there are joint debts i.e. loans then these would pass to your wife but any joint loans/CCs need both parties to sign the agreement forms.
