I will also be going bankrupt in Sussex soon and will have Brighton OR, I like you am also terrified of the OR. I have also not incurred any debt since 2000 but due to a relationship breakdown, being a full time single mum I have had to resign myself to the fact that bankruptcy is my only option. I told my parents a few months ago which was another reason I had not looked at bankruptcy before because I was unsure of what their reaction would be and they have been absolutely fantastic, they are funding for me to use a bankruptcy assistance company, only because they live so far away from me and are unable to help/support emotionally etc. I am hoping that this will be the fresh start that I need for me and my 2 children. Please keep posting with any news that you may have and I will do the same.

Take Care

If im honest its still sinking in with me and sad as it sounds i am looking forward to next payday so i can actually do a proper shop and buy some nice food rather than the recent scrathing by i have had to do (after paying for the br i wasnt left much but just about enough to see me to payday.

It is such a good feeling knowing that i now have a light at the end of the tunnel and a future where i can live a little.

The clerk at Eastbourne is a great guy 'tim' i belive he is called i spoke with him on the phone a few times. make sure you pre book as there were two others waiting for br who had not and they were there considerably longer than myself. there are two service windows in the court reception, one for mags and one for county court, they are both next to each other and the main wait is due to others going for divorce / wills etc.

I got there at 0930 in the hope i may get it over with but the window does not open till ten oclock on the dot which meant half an hour of sick feeling and waiting.

There was someone in front of me who wanted to sort out a divorce but at 5 past ten the br clerk came out and spoke with me and took all of my forms.

The window became free at 20past and again he called me over where i made my payment and i was told to sit and wait.

ten minutes after this the clerk came out and took me upstairs where i was told to wait for the judge. two minutes later i was called into a small room with a table and chairs, the judge asked me if i had recd advice and i confirmed i had, she then granted the br and i was on my toes out of that room asap. then was told to go back downstairs and give papers back to br clerk. . i had to wait as there was at this point about 5 people in front of me but again the cleark came out after ten mins and took the paperwork from me. he then came out ten mins later with the neccesary paperwork and sent me on my way.

You will be fine, i guess human nature causes us to worry but honestly it will be ok. the judge was a lady but she was fine and even managed a smile.

like i said it is still sinking in and its the best feeling ever not to have any aggro from bank calling / letters etc.

as so masny people say on here i only wish i had done this sooner rtaher then the months of hell i went through prior to this. (if anyone had hsbc as a creditor they will know what i mean, 20+ calls a day two letters a week)

Hope you manage to get a date soon and you can then look forward to new begginings

And finally.....I hope i never seen another credit card ever ever again.

i was on a dmp plan prior to br and i cancelled it about two weeks before. had to put up with a couple of calls but knew i would be able to start again after the br.

Hi theguvnor

Thank you so much for posting your experience!
I have also spoken to 'Tim' and I agree,he is so helpful and friendly.
I am in all honesty 'looking forward' to finally going to court. I just need to get the money together. I too am just longing for that relief from creditors and the heavy-sadness I have for getting into this mess.
Like so many others, I paid and paid my bills, always on time etc and never ever anticipated not being able to pay any of my creditors back. So my BR is not through recklessness.
I have been in Eastbourne court..I gathered enough courage to collect the forms.
I also have HSBC as one of my creditors and yes I have found them to be pretty non-understanding!! My debt has been sold to debt agencies and I have so far not had that many calls or even letters.
Luckily I will be moving soon, so it will be a different address.
As soon as I have moved I will tell my DMP about my BR and then as soon as I have the money for the actual BR+assistance I will finally get a date booked!!

I also really dont ever want or have the need to see another credit card!!

Thanks again guvnor!!!!!!!!!!

i understand your worries. i did my br in Eastbourne and the br clerk there was extremely helpful and friendly

Hi again theguvnor

Me too, I am going BR in Eastbourne and I also can verify the people you speak to on the phone are absolutely lovely. They treat you as a normal person...altough I just feel imbarrased about the whole thing in general...but they are so nice and understanding. I had to canx my first planned appointment due to some personal changes but will rebook as soon as I have the money ready.

I am going to have help from a company that has repetatively been mentioned on this site. Even though it should be relatively straight forward I just cannot cope without some help.
I need that 'holding hand'feeling all the way until I am declared discharged and I need to know I can have all my questions answered throughout the BR process.

So I should get another court date booked for approx first week of august.

How was the actual day of going to court in Eastb? Did you see the judge..? How was that..?

I will be going to Brighton County Court.
theguvnor Posted - 08 July 2009 : 17:32:20
I got some advice from mel n and she really really knows her stuff, do the forms yourself, they are very simple if you just take your time and ask on here if you are not sure.

what court are you going to?

Hi Karen
I too was in same position regarding filling out the forms. I ended up doing them myself with lots of assistance from this site. There really is so much help and advice on here. Providing you are as thorough as you can be you can avoid having to use "Assistance" services. Its ironic that when you dont have any money there are so many people out there only too willing to take even more that you dont have for this service!

Best of luck
Ian

Just to advise both Karen Jane & totally lost - you do not have to go through the process via an 'assistance' company - the Citizens Advice Bureau will do the forms with you free of charge - you can book the hearing date at the court br ringing the court direct asking for the bankruptcy clerk, and turn up on the day with 3 copies of the forms (remember to date and sign the forms at the court- and have the correct fee £360 for the court and £150 for the OR if appropriate) why not seek the assistance of the CAB you have the forum for any questions and use the money you would have spent on the assistance on something special for you and the children! (as a Mum and as someone who spent a great deal of time developing the forms to enable people to file for bankruptcy themselves! seriously beilieve this would be a better use of your cash!)
Have a think we can all help either via the forum or you can contact me direct via the 'experts'link I would be only too happy to answer any queries you have either by email or over the phone)

Hi Karen Jane

Welcome to the forum. Its so great that there are some others out there that will go through BR in East Sussex.
I am also just awaiting the funds to have a company to help me with my BR. I just cant do this alone and would feel much happier having someone with lots of experience help me with the millions of questions I have!!

I am hoping I can go to the court at the beginning oof August and I will definately write all my experiences here!!
I think its so great that you have support from your parent!!

Keep your chin up and remember that BR is NOT the end of the world. It has helped so many many people just to get that fresh new start in life and this is all I want for myself.

So best of luck to us Karen !!

I agree that you should be able to do it yourself without having to pay anyone to help you.

You can ask anything you like on here and someone will be able to assist you.

The forms can be completed online via this link:

http://www.insolvency.gov.uk/doitonline/doitonlinemenu.htm

and they can be saved as you go along.

The glimmer gets brighter all the time

Hi Karen,

That's great news about your parents being so supportive. Depending upon your debt circumstances you probably won't need a BR assistance company as it is pretty straight forward to complete the SOA.

Post any questions that you have and we can help you out.
