hi its me again,i got so many questions really.thanks to this forum because its helping and to the people whose got time to help.no one i can talk to about my situation now because im alone.i want to lessen my contract hour on my job which is from 48hours to 40hours a week.just to be qualified going bankrupt.i want to have a fresh start to be able to support my dad and sister back home who are ill.and my kids also.if i lessen my contract hour to 40hours and my reason is having really a back pain and that is true,will the or ask me why i lessen my contract hour?is this will cause a problem filling my bankruptcy?.i am planning to go bankrupt on september.

I am sure you will be able to support your kids, but your father and sister are very doubtful.

Please pick up the phone and speak to Reviva. The advice you will get from them is free.

A 48 hour week is more than the norm though, so to reduce it by 8 hours to put it in line with most other workers is unlikely to be seen in a bad light by the OR I would have thought.

Rabbit007, your case is very complex and you really do need to take specialist advice. As Jan suggested Paul Johns at Reviva would be a good person to contact - he is very well respected and will give you good advice.

To be blunt, how much do you earn? if you are not in a well paid job you probably won't have to pay any money once you are BR BUT you won't be able to get credit & I think it important that you tell your family back home that you may be sending less their way.

I agree.

Anything over £100 a month and you will lose 50-70% of that, but the rest would be yours to do as you wished with.

If you can afford to send some of that to support your family then you could do so.

I think that you would also be shooting yourself in the foot as the OR only takes a proportion of your surplus income leaving the rest for you so you would be denying yourself income

If your working hours are reduced for a good reason (i.e. they are reduced by your employer, for health reasons, etc.) then there won't be a problem. If you reduce your hours in order that your disposable income is less than £100 so you won't get an IPA then this could cause problems with the OR.

You do not have to lessen your contract to go bankrupt. If you cannot afford to make payments to your creditors, regardless of how many hours you work, then you are insolvent.

I am still not sure whether or not the OR will be happy with you supporting your father and sister. Your kids, yes.

Why don't you do as I suggested in a previous post and contact Reviva UK? Paul Johns is a well respected expert on here and he will give you free advice.
