Posted - 21 July 2009 : 15:17:10 NR really like to spend taxpayers money on pointless legal proceedings to confirm that they can posess, reposess and finally evict you - even though you have probably alrady left some many months earlier.
You can lead a horse to water but you can't make him accept the keys back if they want to be bloody minded.

Posted - 21 July 2009 : 10:47:25 In my experience, NR will only accept the form if its the one they have sent out, DO NOT sign that one, it will have a paragraph in it about you still being liable for shortfall, etc
I told them on the phone of my plans and sent them a letter (they said not to sent any keys as they will change the locks) saying:
I hereby voluntarily surrender the property at xxxx Street to NR, as I will shortly be declaring bankruptcy, any shortfall, mortgage arrears, selling costs and interest, etc will be included in my bankruptcy, blah, blah, blah (something like this)
I have to say, NR took not a blind bit of notice of this, as I had not signed their own forms, they still had to go through the repossession procedure, costing themselves more money, this took 13 months and the house as since sold for a pittance |
